A 43-year-old man faces charges of murder and attempted murder after two men were shot – one fatally – in his Herkimer County driveway, New York State Police say.

Stephen E. Swanton, who is also of Rochester, was charged with second-degree murder and second-degree attempted murder, troopers say.

Scott R. Krempler, 50, of Patterson, was pronounced dead at Swanson’s home on Saturday, troopers said.

A second man, William J. Robertello, 55, of Oriskany, was flown to Upstate University Hospital with a gunshot wound. He has been treated and released, according to troopers.

Police were called to 168 Dan-Bar Acres Road – Swanton’s home — in the town of Webb at about 8:27 p.m. Saturday, troopers said. They were responding to a reported home invasion.

Troopers say they later discovered that Swanton and the two men had been arguing earlier on Saturday at a nearby party. That dispute continued outside Swanton’s home, according to state police.

“During the altercation it appears Swanton shot both individuals with a handgun in his driveway,” state police said in a news release.

Swanton was taken into custody by Webb and Inlet police officers.

Swanton is being held in the Herkimer County Jail on no bail.
